Data Elements
District 70 is a Local Education Provider (LEP) that follows the Student Data Transparency and Security Act (C.R.S. Section 22-16-101, HB16-1423). This act requires us to disclose the student data elements (such as name, address, ethnicity, test scores, etc.) that we collect and store in our data systems, except for those that are reported to the Colorado Department of Education (CDE).

D70 values data privacy and security and ensures that our student’s data is protected and compliant with the Family Educational Rights and Privacy Act (FERPA) and the Colorado Student Data Transparency and Security Act (HB 16-1423).
Besides the data that CDE collects, D70 also collects and stores the following information in our Student Information Systems:

We also provide the data inventory and dictionary of data elements that the state Board of Education publishes. D70 uses this data to achieve our mission of providing academic excellence and shares the necessary student PII with School Service Providers that we carefully vet and that use the most secure data encryption and security methods according to the current industry best practices and standards. Data Definitions
“Directory Information” is information in a student’s educational record that is not generally harmful or invasive to privacy if disclosed. FERPA requires each institution to define its “Directory” items.
District 70 defines the following student information as Directory Information. Parents can choose to allow or deny this information’s release on their student when they register their student through Infosnap.
• Full Name
• Grade Level
• Earned awards, degrees, and honors
• Participation in athletics (including height, weight), clubs, organizations
“Student Personally Identifiable Information” (Student PII) is information that, by itself or combined, personally identifies a student or the student’s parent or family, and that a public education entity collects, stores, generates, or infers, either directly or through a school service, or by a school service contract provider or school service on-demand provider.
“Local Education Provider” (LEP) is a School District, a Charter School authorized by a School District under Part 1 of Article 30.5 of this Title, a Charter School authorized by the State Charter School Institute under Part 5 of Article 30.5 of this Title, or a Board of Cooperative Services created and operating under Article 5 of this Title that runs one or more Public Schools.
“Public Education Entity” is the Department, a LEP, the State Charter School Institute established in section 22-30.5-503, or a Public School.
“School Service” is an internet website, online service, online application, or mobile application that:
§ (i) is made and sold mainly for preschools, elementary schools, or high schools;
§ (ii) is used by teachers or other staff of a LEP; and
§ (iii) collects, keeps, or uses Student PII.
§ “School Service” does not mean a website, app, or online service that is made and sold for anyone or any group, even if it is also sold to a United States preschool, elementary school, or high school.
“School Service Contract Provider” or “Contract Provider” means a group, other than a public education group or a college, that signs a formal, agreed contract with a public education group to provide a school service.
“School Service On-Demand Provider” or “On-Demand Provider” means a group, other than a Public Education Group, that provides a School Service sometimes to a Public Education Group, if the Public Education Group, or an employee of the Public Education Group, agrees to the standard, fixed terms and conditions of service set by the providing group.
“Student Data System” means the Colorado Department of Education Student Data Collection System.
“Vendor” means a business or other group that a public education group hires for a product or service. “Vendor” includes a School Service Contract Provider.
“Targeted Advertising” means choosing and sending ads to a student based on information learned or guessed over time from the student’s online actions, use of apps, or Personally Identifiable Information. It does not include:
(a) Advertising to a student:
(I) . at an online place or when the student is at that place or when the student asks for information or feedback: and
(II) . without collecting and keeping a student's online actions over time:
(b) Adaptable learning, personalized learning, or customized education: or
©. with the permission of a student or the student’s parent, using the student’s PII to find for the student colleges or scholarship providers that are looking for students who have specific qualities.
